What’s New in April, 2012?

On April 30, 2012 a new workplace poster is required for most employers including:
• Employers with a unionized workforce
• Non-Profit Organizations and
• Non-Union Employers
The notice advises employees that they have certain rights under the National Labor Relations Act (“NLRA”) including the rights to unionize and to discuss wages, benefits and terms and conditions of employment with their co-workers. The posting further communicates that employers are prohibited from discriminating or retaliating against employees who exercise their rights.
Employers who do not post will not be fined or penalized by the National Labor Relations Board (NLRB) as they do not have that authority. However, the NLRB can treat the failure to post as an unfair labor practice in violation of the NLRA.
